On September 10, 2009, the Court in Milliron v. T-Mobile USA, Inc. entered an order granting final approval to the class action settlement. The deadlines to file a claim, object to the settlement or request exclusion from it have passed.

The distribution of settlement benefits will be delayed because objectors to the settlement have filed appeals challenging the Court's final approval order. Benefits will not be distributed until the appeals process is complete. Please be patient.

A customer of T-Mobile has sued that company alleging that T-Mobile violated her rights under the laws of various states, as well as federal law, by imposing flat-rate ETFs. The Court has allowed the lawsuit to be a class action for the purposes of settlement. The Settlement Class includes all subscribers to T-Mobile with personal accounts who paid or were charged a flat-rate ETF at some time during the period July 23, 1999 through February 19, 2009, and/or who have or had a contract for service with T-Mobile that included a flat-rate ETF at some time during the period July 23, 1999 through February 19, 2009.

The Court has not decided whether the claims made in the lawsuit have any merit. However, if you are a member of the Settlement Class, you have a choice to make now.

SUBMIT A CLAIM FORM BY NOVEMBER 9,2009

Stay in this lawsuit. Submit a Claim Form. Await the outcome. If the Settlement is approved by the Court, you may be eligible for money or non-cash compensation under the Settlement. Be bound by the result.

By submitting a Claim Form you keep the possibility of getting money or benefits that may come from the Settlement. But you give up any right to ever be part of any other lawsuit against T-Mobile about any issues relating to the flat-rate ETF.
ASK TO BE EXCLUDED BY JULY 2, 2009

Get out of this lawsuit. Get no benefits from it. Keep rights.

If you ask to be excluded and money or other benefits are later awarded, you will not share in those. But you keep your right to sue T-Mobile separately about the same legal claims in this lawsuit.
SUBMIT AN OBJECTION BY JULY 2, 2009

Object to the Settlement.

Stay in the lawsuit, but submit an objection. By objecting to the Settlement you give up your right to be excluded from the Settlement and your right to file your own action. If you object to the Settlement, you may ask a lawyer to represent you at your own cost.
DO NOTHING Get no money or non-cash compensation. Give up your right to ever be part of any other lawsuit against T-Mobile about any issues relating to the flat-rate ETF.
